1. Agreement and Acceptance

These Terms of Use ("Terms") govern your use of the Electe API ("API") provided by Electe S.r.l. ("Electe", "we", "us", or "our"). By accessing or using the Electe API, you ("Developer", "you", or "your") agree to be bound by these Terms.

2. Description of Service

The Electe API provides programmatic access to project management, user authentication, and real-time webhook functionality. The API enables developers to integrate Electe's services into their applications and workflows.

3. Free Usage Model

  • Authenticated Users: 1,000 requests per hour
  • Anonymous Users: 100 requests per hour
  • Features: Full access to all API functionality
  • Support: Community support via email

3.1 Fair Use Policy

Our free API is provided for legitimate development and business use. We reserve the right to limit access if usage patterns adversely affect service availability for other users.

4. API Access and Authentication

4.1 Registration

To use the API, you must create an account and obtain valid authentication credentials. You are responsible for maintaining the confidentiality of your credentials.

The API uses JWT (JSON Web Tokens) for authentication. All authenticated requests must include a valid Bearer token in the Authorization header.

Your API access is personal and non-transferable. You may not share, sell, or otherwise distribute your API credentials.

We implement industry-standard security measures to protect data transmitted through the API. However, you acknowledge that no method of transmission over the Internet is 100% secure.

7.1 Electe's Rights

The API and all related documentation are protected by copyright and other intellectual property laws. Electe retains all rights, title, and interest in the API.

7.2 Your Rights

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the API during the term of these Terms.

8. Service Availability and Support

8.1 Availability

We strive to maintain high API availability but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects API access.

8.2 Support

Developer support is provided via email at support@electe.net. We aim to respond to technical inquiries within 48 hours during business days.

8.3 Service Updates

We may update the API from time to time. Material changes will be communicated via email and our documentation portal.

9. Warranties and Disclaimers

9.1 Service Warranty

We warrant that the API will perform substantially in accordance with our published documentation under normal use conditions.

9.2 Disclaimer

THE API IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELECTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Termination

11.1 Termination by You

You may terminate your use of the API at any time by discontinuing access and deleting your credentials.

11.2 Termination by Electe

We may suspend or terminate your API access if you violate these Terms, your usage adversely affects our service, or as required by law.

12. Modifications to Terms

We may modify these Terms from time to time. Material changes will be communicated via email notification to registered users and prominent notice on our API documentation website.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Italy. Any disputes arising from these Terms or use of the API will be subject to the exclusive jurisdiction of the courts of Milan, Italy.

14. Miscellaneous

14.1 Entire Agreement

These Terms constitute the entire agreement between you and Electe regarding the API and supersede all prior agreements.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
